These Terms of Use (“Terms”, “Agreement”) constitute a legally binding agreement between you (“User”, “Customer”, “Tasker”, “Service Provider”) and MYJOBLER SOLUTIONS (“JobLer”, “the Company”, “we”, “our”), a Malaysian-registered company.
By accessing or using the JobLer mobile application, software, website, and related services (“Platform”), you agree to be legally bound by these Terms. If you do not agree, discontinue use immediately.
1. DEFINITIONS
“Tasker” – An independent contractor providing services via the Platform.
“User” – A customer booking a service through the Platform.
“Services” – Any task, job, or service offered by Taskers.
“Misconduct / Misbehaviour” – Any unlawful, dangerous, fraudulent, abusive, unethical, harassing, or harmful behavior, as detailed in Clause 16.
2. LEGAL STATUS OF JOBLER
2.1 JobLer is a technology platform, not an employer, contractor, agent, or service provider.
2.2 Taskers are not employees of JobLer; they are independent contractors.
2.3 JobLer is not a party to any contract between Users and Taskers.
2.4 JobLer is not responsible for:
Safety or conduct of Taskers or Users
Quality, legality, or outcome of services
Property damage, personal injury, financial loss, or criminal acts
3. ELIGIBILITY
You must:
Be 18 years or older
Be legally competent under Malaysian law
Have full civil capacity to enter into agreements
Fake accounts or impersonation is strictly prohibited.
4. ACCOUNT SECURITY
You must:
Maintain confidentiality of your login details
Be fully responsible for activities under your account
Notify JobLer immediately in case of breach
JobLer may suspend or terminate accounts suspected of fraud, misuse, or illegal activity.
5. BOOKINGS, PAYMENTS & FEES
5.1 All bookings must be made within the Platform.
5.2 JobLer may charge platform fees, service fees, cancellation fees, or penalties.
5.3 Payments are held in escrow and released only after:
Completion confirmation by User, or
JobLer decides based on evidence
5.4 JobLer reserves the right to:
Reverse payments
Hold funds for investigation
Deduct penalties or damages
6. CANCELLATION AND REFUNDS
Refunds are not guaranteed and evaluated solely at JobLer’s discretion.
Once a Tasker arrives at the location, no full refund applies.
Taskers who cancel repeatedly may face penalties, suspension, or legal action.
7. TASKER OBLIGATIONS (STRICT)
Taskers must:
Perform services with skill, care, and professionalism
Comply with all Malaysian laws (including Occupational Safety standards and relevant regulations)
Maintain tools, equipment, insurance (optional), and conduct themselves responsibly
Not engage in fraud, theft, harassment, or unsafe behavior
Failure may result in:
Account suspension
Non-payment
Police reports
Legal action
8. USER OBLIGATIONS
Users must:
Provide accurate job information
Ensure safe access to property
Not mislead, harass, threaten, or endanger Taskers
Not request illegal, dangerous, or inappropriate tasks
9. PROHIBITED CONDUCT (STRICT & ENFORCEABLE)
The following is strictly prohibited by both Users and Taskers:
9.1 Criminal Misconduct
Including but not limited to:
Theft, burglary, or attempted theft
Assault, harassment, intimidation, threats, verbal abuse
Sexual harassment or inappropriate conduct
Damage to property, vandalism
Fraud, identity fraud, impersonation
Attempting to defraud the escrow system
Using fake documents or false identity
Criminal behavior may be reported to:
Royal Malaysia Police (PDRM)
Malaysian Communications and Multimedia Commission (MCMC)
Relevant regulatory authorities
9.2 Dangerous or Unlawful Acts
You may not:
Engage in violence
Carry weapons (unless legally licensed and relevant)
Handle illegal substances
Request or perform illegal services
9.3 Misuse of the Platform
You may not:
Circumvent JobLer by arranging “off-platform” deals
Tamper with payments or manipulate pricing
Upload viruses, bots, malware, or harmful scripts
Post defamatory, abusive, racist, or obscene content
Violations may result in immediate termination.
10. SAFETY DISCLAIMER
JobLer conducts basic ID verification but does NOT guarantee:
Criminal background checks
Safety, purity of identity, or trustworthiness
Professional qualifications of Taskers
Users and Taskers assume all risks, including entry into private premises.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by Malaysian law:
JobLer is NOT liable for:
Personal injury, death, or accidents
Theft, loss, or damage to property
Loss of profits, revenue, or business
Service errors, delays, cancellations
Negligence or wrongdoing by Users or Taskers
JobLer’s total liability (if any) is limited to the total platform fees paid within the last 3 months.
12. INDEMNITY
You agree to indemnify and defend JobLer from all claims, liabilities, damages, losses, or legal costs arising from:
Your use of the Platform
Your violations of these Terms
Your misbehaviour, misconduct, or illegal actions
Your disputes with other Users or Taskers
13. INTELLECTUAL PROPERTY
All Platform content is owned by JobLer and may not be copied, reproduced, or exploited without written permission.
14. REVIEWS & PUBLIC FEEDBACK
JobLer may remove:
Fake reviews
Defamatory content
Abusive or malicious statements
JobLer may publish reviews for marketing.
15. PRIVACY
Your data is handled according to the JobLer Privacy Policy and in line with the Malaysia Personal Data Protection Act (PDPA 2010).
16. MISBEHAVIOUR POLICY (STRICT LAW ENFORCEMENT CLAUSE)
Any User or Tasker engaging in misbehaviour, including but not limited to:
Threats, insults, harassment, intimidation
Sexual misconduct, indecent behavior
Theft or attempted theft
Recording inside private premises without consent
Destruction of property
Accepting or offering bribes for off-platform work
Violent acts, abuse, or endangerment
Attempting to scam, cheat, or defraud
JobLer may take the following actions:
Immediate account suspension
Permanent ban from the Platform
Forfeiture of payments or earnings
Reporting to PDRM or relevant authorities
Legal action under Malaysian law, including:
Penal Code (Criminal offences)
Communications and Multimedia Act 1998
Computer Crimes Act 1997
PDPA 2010
Contract Act 1950
JobLer reserves the right to fully cooperate with law enforcement investigations.
17. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of Malaysia.
Disputes will follow:
Internal mediation
Arbitration (if applicable)
Courts of Malaysia
18. TERMINATION
JobLer may terminate accounts without notice for criminal behavior, misconduct, or violations of these Terms.
Users may terminate their account at any time, but outstanding obligations continue.
JOBLER – TASKER / SERVICE PROVIDER LEGAL AGREEMENT
This Tasker Agreement (“Agreement”) is made between:
MYJOBLER SOLUTIONS (“JobLer”, “the Company”, “we”, “our”)
AND
The individual registering as a service provider on the JobLer Platform (“Tasker”, “you”, “your”).
By registering as a Tasker and using the JobLer Platform, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.
1. DEFINITIONS
“Platform” – The JobLer app, website, and related systems.
“Tasker” – An independent contractor providing services through the Platform.
“User” – A customer who books services.
“Services” – Any job, task, or work performed by the Tasker.
2. INDEPENDENT CONTRACTOR STATUS
2.1 You are an independent contractor, not an employee of JobLer.
2.2 This Agreement does not create:
Employment relationship
Partnership
Agency
Joint venture
2.3 You are responsible for:
Your own taxes (income tax, SST if applicable, business tax)
Your transportation costs, tools, equipment, materials
Your insurance (personal accident or public liability, if any)
2.4 JobLer does not provide EPF, SOCSO, medical coverage, insurance, or employment benefits.
3. TASKER ELIGIBILITY & REQUIREMENTS
To be a Tasker, you must:
Be at least 18 years old
Hold a valid IC or passport
Be legally allowed to work in Malaysia
Provide accurate registration details
Have the necessary skills and experience for the services offered
Pass JobLer’s verification checks (ID, background if required)
Not be involved in criminal activities
4. TASKER RESPONSIBILITIES
You agree to:
4.1 Service Quality
Perform services with professionalism, skill, and care
Deliver services safely and efficiently
Arrive on time and respect User property
4.2 Safety & Conduct
Follow all Malaysian laws and regulations
Maintain appropriate tools and equipment
Behave respectfully toward Users
Avoid reckless or dangerous behaviour
4.3 Transparency
Clearly state your pricing or accept the Platform’s pricing structure
Inform the User of additional costs BEFORE performing extra work
4.4 Communication
Respond promptly to Users
Update the job status within the Platform
5. PROHIBITED CONDUCT
The following actions will result in immediate termination, non-payment, and possible legal action:
5.1 Criminal Conduct
Theft, attempted theft, breaking/entering
Harassment, threats, violence, assault
Sexual misconduct or inappropriate behaviour
Recording within User premises without consent
Damage to User property
5.2 Fraud & Dishonesty
Fake identity, documents, or credentials
Manipulating payments
Canceling jobs to force higher prices
Intentionally delaying work
5.3 Platform Misuse
Contacting Users for “off-platform” jobs
Sharing personal contact details to bypass JobLer
Accepting cash payments unless permitted
Posting false or misleading information
5.4 Safety Violations
Working intoxicated (drugs or alcohol)
Using unsafe tools
Performing tasks beyond your capability
6. PAYMENT TERMS
6.1 JobLer will release your payment only after:
The User confirms job completion, or
JobLer determines completion via evidence
6.2 JobLer may deduct:
Platform service fees
Penalties for cancellations
Compensation for damages caused by the Tasker
Chargebacks or refunds to the User
6.3 Payments may be withheld if:
There is suspicion of fraud
A dispute is ongoing
You violated this Agreement
7. CANCELLATIONS
You agree to:
Not cancel jobs without valid reasons
Inform the User early if delays occur
Frequent cancellations may result in:
Reduced job opportunities
Penalties
Account suspension
8. LIABILITY & DAMAGES
8.1 You are fully responsible for:
Damage caused to User property
Loss of items
Personal injury due to your negligence
Misconduct or unlawful acts
8.2 If the User submits evidence showing damage or loss caused by you:
JobLer may deduct compensation from your earnings
JobLer may require you to reimburse the User
JobLer may terminate your access to the Platform
9. DISPUTE RESOLUTION
If a dispute arises:
Submit evidence through the JobLer Platform
JobLer will review and make a final decision
If unresolved, either party may pursue mediation or legal action under Malaysian law
JobLer’s decision regarding payments is final.
10. BACKGROUND CHECKS
You agree that JobLer may conduct:
ID verification
Criminal checks (if required)
Skill or qualification checks
Random audits
Failure to pass may result in termination.
11. PRIVACY
Your data will be processed according to JobLer’s Privacy Policy and in compliance with the Personal Data Protection Act (PDPA 2010).
12. TERMINATION
JobLer may suspend or permanently ban you if:
You breach this Agreement
You commit fraud or misconduct
You violate Malaysian law
You receive repeated User complaints
You may stop using the Platform anytime, but outstanding obligations remain enforceable.
13. INDEMNIFICATION
You agree to indemnify and hold JobLer harmless from:
Claims
Damages
Losses
Legal fees
arising from your actions, negligence, or breach of this Agreement.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
JobLer is not liable for your losses, injuries, or damages
JobLer’s total liability is limited to the total platform fees paid to JobLer
You assume full responsibility for your work
15. GOVERNING LAW
This Agreement is governed by the laws of Malaysia, including the:
Contract Act 1950
Penal Code
PDPA 2010
Communications and Multimedia Act 1998
Consumer Protection Act (where applicable)
